U.S. Chemical Safety Board examines potential impacts of MIC release

Ken Ward Jr. over at the Charleston Gazette has obtained a study conducted by the United States Chemical Safety Board which details the community impacts that could result from a potential MIC leak at the Bayer CropScience facility located in Institute, WV.

Ken Ward, Jr. reports, “Thousands of people living within four miles of the Bayer CropScience plant in Institute could have been exposed to potentially harmful levels of methyl isocyanate if the contents of an MIC tank located near an August 2008 explosion had been released…”

The U.S. Chemical Safety Board report concluded that residents who live within a one mile radius of the Bayer CropScience facility could have been exposed to MIC concentrations that are “immediately dangerous to life or health”.

Kanawha Residents seek extension of MIC Restraining Order

In the Tuesday, February 14, 2011, issue of the Charleston Daily Mail, business editor George Hohmann reports that Attorney William DePaulo, who represents 16 Kanawha Valley residents, has filed a motion to extend the recent court order which bars Bayer CropScience from restarting the MIC unit at the Institute Industrial Park.

A hearing is scheduled February 25, 2011.

“Goodwin issued a temporary restraining order against Bayer CropScience after DePaulo argued that the company has a “very checkered” safety record; “did everything wrong they could do wrong” leading up to a fatal Aug. 28, 2008, explosion at the plant; “didn’t let the people outside know” after the accident; and later tried to hide information.”

CHARLESTON, W.Va. — “Kanawha Valley residents want Bayer CropScience to turn over any company studies that examined the risks and potential consequences of a major release of the deadly chemical methyl isocyanate from its Institute plant.”

“William DePaulo, a lawyer for Maya Nye and other residents, said he wants the studies to use as evidence as he pursues a longer-term court order to block Bayer from resuming production of MIC, a pesticide ingredient, at the sprawling Institute facility.”

We were just granted a temporary restraining order against Bayer CropScience to prevent them from restarting the MIC unit, which was admitted in court had not been inspected prior to the startup of the unit.
What we need now is MONEY!  We have a $10,000 bond we need to meet and money for court costs which will be substantial.  Any little bit helps!!!

Federal Suit Filed to Prevent Bayer’s Resumption of MIC Production; Alleges New Process “Uncontrolled Experiment” and 83 MIC Leaks in 80s

INSTITUTE, WV (HNN) – Multiple plaintiffs have filed a federal civil rights complaint to block resumption of MIC production at the Bayer Cropscience plant in Institute, WV.

One portion of the complaint alleges that “toxic chemicals were released into the atmosphere between 1980 and 1985: 61 MIC leaks; 107 phosgene leaks, and 22 leaks of both MIC and phosgene all prior to the August 28, 2008 (explosion) and all without reporting the release as required by law.”

Furthermore, the modified MIC process start up allegedly is not patterned after a Dupont facility in Texas, rather, the complaint alleges “the new process for MIC at Bayer’s current facility has never been employed at any location in the United States or anywhere else; its startup is, for all practical purposes an uncontrolled experiment being conducted in a major population center in which 300,000 citizens reside.”

WVSU Faculty Senate Has Warned Bayer-Crop Eight Times About Chemical Leaks

West Virginia State University President Hazo Carter has sent eight letters to Bayer Crop-Sciences and its former subsidiary Rhone-Poulenc in regards to previous chemical leaks that has occurred at the facility in Institute, which sits adjacent to West Virginia State University. In each of the letters Carter expressed concern over the chemical leaks, emergency preparedness and the safety of the students and the community.
